Advocate Tembeka Ngcukaitobi has been appointed as an Acting Justice of the Constitutional Court of South Africa, in a landmark development for the country’s highest court.
His appointment will run from 1 June 2026 to 30 November 2026, marking a significant moment in South Africa’s judicial history. Ngcukaitobi becomes the first Black advocate to be appointed directly from the Bar to the Constitutional Court in an acting capacity.
Widely respected in legal circles, Tembeka Ngcukaitobi has built a reputation as a prominent advocate and legal scholar, and his elevation is expected to bring a distinct voice to the bench during his term.
His appointment follows closely after the recent addition of two female judges, a move that has contributed to the Constitutional Court becoming one of the few top courts globally with a female majority.
Legal observers say Ngcukaitobi’s entry into the court represents a notable shift in its composition, with attention now turning to the impact he may have on upcoming constitutional matters during his tenure.
