Mbenenge challenges gross misconduct finding as impeachment threat looms

Eastern Cape Judge President Selby Mbenenge has filed a review application challenging the Judicial Service Commission’s (JSC) finding that he committed gross misconduct, a move that could significantly impact disciplinary proceedings that may ultimately lead to his impeachment.

The case stems from allegations made by court clerk Andiswa Mengo, who accused Mbenenge of making unsolicited sexual advances towards her between 2021 and 2022.

During proceedings before the Judicial Conduct Tribunal, Mengo testified that she received sexually explicit text messages and images from the Judge President. She maintained that the communications were unwanted and constituted sexual harassment.

Mbenenge denied wrongdoing and argued that his interactions with Mengo formed part of a consensual relationship. In his defence, he maintained that the exchanges between the two were mutual and not unsolicited.

The Judicial Service Commission subsequently found Mbenenge guilty of gross misconduct, a finding that places him at risk of impeachment and possible removal from office.
