The Constitutional Court of South Africa will hear a legal challenge against the National Health Insurance Act from 5 to 7 May, focusing on whether Parliament followed proper procedures when passing the law.
The case, brought by the Board of Healthcare Funders and the Western Cape Government, argues there was inadequate public consultation during the Bill’s drafting and adoption.
Following the challenge, President Cyril Ramaphosa—in consultation with Health Minister Aaron Motsoaledi—has agreed to delay implementing parts of the Act until the court delivers its ruling.
While groundwork for the NHI continues, the outcome of the case could significantly impact the future rollout of universal healthcare in South Africa.
