The High Court has ruled against the African National Congress (ANC) in a legal battle over the removal of National Executive Committee member Andile Lungisa from the party’s proportional representation (PR) candidate list for Nelson Mandela Bay ahead of the 4 November local government elections.
Lungisa challenged his exclusion from the list, arguing that his candidacy had been approved through the party’s internal structures and that his removal was unlawful.
The dispute centres on allegations that ANC Secretary-General Fikile Mbalula instructed party officials to remove Lungisa’s name from the list despite his alleged ranking as the number-one candidate in Nelson Mandela Bay.
Lungisa sought an order declaring his removal unlawful and compelling the party to reinstate him on the candidate list.
The ANC disputed his claims, maintaining that Lungisa had not participated in the required candidate-vetting process and that adverse findings had emerged against him.
Mbalula also denied personally ordering Lungisa’s removal, saying he acted on an instruction from the ANC Electoral Committee.
