The National Prosecuting Authority (NPA) has instituted disciplinary action against a prosecutor in Mpumalanga after he was convicted of contempt of court for failing to appear during a high-profile bail application in the Kwaggafontein Magistrate’s Court.
In a statement issued on Monday, the NPA confirmed that the prosecutor would be suspended pending disciplinary proceedings following the incident, which resulted in a case involving extortion and money laundering charges being struck off the court roll.
The matter relates to the case of State versus Madoda Johannes Sibanyoni and others. According to the NPA, the prosecutor failed to appear in court on 18 May 2026 for the continuation of the accused’s bail application, prompting the magistrate to authorise a warrant for his arrest.
The NPA said the case can now only be reinstated through written authorisation from the Director of Public Prosecutions in Mpumalanga.
National Director of Public Prosecutions, Adv Andy Mothibi, expressed shock and disappointment over the incident, saying the authority is handling the matter both internally and in cooperation with the South African Police Service (SAPS).
“The Director of Public Prosecutions is engaging with the investigating officer with a view to facilitating the re-enrolment of the case,” the statement read.
Mothibi assured the public that the setback would not prevent the prosecution of those accused in the matter.
“While this is disappointing, it is not a setback as we are within our right and authority to reinstate the case once there is compliance with the legal provisions governing matters removed from the court roll in this manner,” said Mothibi.
He added that the NPA remains committed to ensuring accountability and combating impunity.
