Shadrack Sibiya files appeal against court’s decision to deny him bail

Former Deputy National Police Commissioner Shadrack Sibiya has filed an appeal against the decision by the Randburg Magistrates’ Court to deny him bail.

Sibiya was denied bail on 20 October 2026, after the court ruled against his release following lengthy bail proceedings.

The State had opposed his release, arguing that he posed a flight risk and could interfere with or intimidate witnesses if released.

During the bail proceedings, the defence offered R20 000 bail and challenged the State’s case against him.

Sibiya faces several serious charges, including the alleged rape of an 18-year-old woman, sexual grooming of his driver’s 16-year-old daughter, human trafficking and charges relating to the Firearms Control Act.

He has denied the allegations.

Sibiya was arrested in September 2026 and remained in custody after his bail application was dismissed. He subsequently resigned from the South African Police Service (SAPS), with his resignation taking effect on 12 October while disciplinary proceedings were underway.
