Bushiri extradition battle suffers setback as Malawi court upholds earlier decision

Prophet Shepherd Bushiri and his wife, Mary, have secured a legal victory in Malawi, where the High Court has upheld a decision overturning an order that could have enabled their extradition to South Africa.

The ruling, delivered by Justice Mzonde Mvula in Lilongwe, centres on the March 2025 committal order issued by the Chief Resident Magistrate. The High Court found procedural and legal shortcomings in the extradition process, including the couple not being afforded a proper opportunity to be heard.

Their lawyer, Wapona Kita, said the decision prevents the couple from being extradited under the quashed order. However, the state may still appeal the judgment.

Bushiri welcomed the outcome, citing concerns about the evidence against them, alleged police misconduct, the handling of witnesses and their safety should they return to South Africa.

The couple left South Africa for Malawi in 2020 while on bail. They are facing charges of fraud, theft and money laundering linked to their Enlightened Christian Gathering ministry. Both have denied the allegations.

They have previously challenged their extradition, arguing that they would not receive a fair trial and would face safety risks if returned to South Afric
