Parliament Moves to revive Ramaphosa impeachment process after Constitutional Court ruling

The Speaker of the National Assembly, Thoko Didiza, says Parliament will comply with a landmark Constitutional Court ruling that declared parts of the National Assembly’s impeachment rules unconstitutional and ordered the revival of the Section 89 process linked to the Independent Panel report chaired by former Chief Justice Sandile Ngcobo.

The court set aside Rule 129I of the National Assembly Rules and invalidated Parliament’s 2022 decision not to refer the Independent Panel report to an impeachment committee. It ordered that the report now be referred to an Impeachment Committee established under parliamentary rules.

Parliament said the ruling reaffirmed the National Assembly’s constitutional duty to ensure accountability and oversight.

Among the immediate steps announced by Didiza is the formal tabling of the report, providing President Cyril Ramaphosa with a copy, and starting the process of establishing an Impeachment Committee to conduct the Section 89 inquiry.

The Constitutional Court judgment will also be referred to Parliament’s Rules Review Subcommittee to align the National Assembly’s rules with the court’s findings.
