JSC Recommends Ramaphosa suspend Eastern Cape Judge President

The Judicial Service Commission (JSC) has recommended that President Cyril Ramaphosa suspend Eastern Cape Judge President Selby Mbenenge after finding him guilty of gross misconduct linked to a sexual harassment complaint.

The recommendation follows the JSC’s earlier finding that Mbenenge committed gross misconduct over allegations made by court secretary Andiswa Mengo, who accused him of sexually harassing her through inappropriate WhatsApp messages and unwanted advances.

The commission unanimously advised the President to suspend Mbenenge under Section 177(3) of the Constitution while the National Assembly considers impeachment proceedings.

If Parliament votes by a two-thirds majority to remove him from office, President Ramaphosa will be able to formally dismiss the judge.

Mbenenge has denied the allegations and is challenging the JSC’s findings in court while seeking to halt the impeachment process.
