South Africans will be able to claim up to R30,000 through Small Claims Courts from 1 August 2026, following an increase in the courts’ monetary jurisdiction from R20,000.
The Department of Justice and Constitutional Development said the first increase in seven years is aimed at improving access to justice by allowing more people to resolve civil disputes without legal representation.
Deputy Minister Andries Nel said the move will help South Africans enforce their rights without the expense of lengthy court proceedings, adding that it supports government’s goal of creating a more accessible and affordable justice system.
South Africa’s 418 Small Claims Courts handled around 36,000 cases worth R257 million in the last financial year. The courts deal with matters such as unpaid debts, consumer complaints, vehicle disputes and credit agreement claims.
The department said further increases to the monetary limit are being considered.
