The Labour Court in Johannesburg has dismissed an application by University of
Limpopo lecturer Phindile Raymond Msaule to overturn a ruling that upheld his unpaid
suspension. The court found that his refusal to carry out teaching duties was unjustified
and negatively affected students.
Acting Judge Ndivhuho Tshisevhe ruled that the CCMA’s decision was reasonable,
confirming that the university acted fairly in disciplining Msaule for insubordination and
neglect of duties.
The dispute arose in 2021 when Msaule refused to teach a module after objecting to a
co-teaching arrangement. Despite raising concerns, he failed to follow proper grievance
procedures and stopped performing his duties.
The court held that even if a grievance had been filed, he was still required to continue
working. It concluded that his conduct was unacceptable and upheld the arbitration
ruling, with no cost order made.
