Eastern Cape Deputy Judge President post remains unfilled

The Eastern Cape High Court remains without a permanent Deputy Judge President after the Judicial Service Commission (JSC) concluded interviews for the position without announcing a recommended candidate.

Four judges were interviewed on Tuesday for the Gqeberha-based position, which has been vacant since the retirement of Judge David van Zyl in 2025.

The vacancy comes amid continued uncertainty surrounding Eastern Cape Judge President Selby Mbenenge, who has been on special leave since December 2023 following a sexual harassment complaint by court secretary Andiswa Mengo.

The JSC found Mbenenge guilty of gross misconduct in April 2026, but he obtained an interdict preventing his suspension while he challenges the findings.

During the interviews, Judge Buyiswa Majiki said there was reluctance within the division to openly discuss sexual harassment and called for the issue to be addressed more routinely.

The interviews also highlighted concerns over case management, missing court files and the administration of the Mthatha High Court.

The JSC is expected to announce the outcome of its deliberations at a later stage.
